Franchise Offer: The franchise on offer is to own and operate a Winzer businesses which sell quality packaged fasteners, nuts, bolts, clamps, adhesives, sealers, electrical components, cutting tools, fluid power fittings, chemicals, shop supplies, and other related parts and services. The franchisee will sell, directly or on the franchisor’s behalf, primarily to retailers and end users.
Financial Assistance: Neither the franchisor nor any agent or affiliate offers direct or indirect financing, guarantees any notes, leases or obligations, or has any practice or intent to sell, assign or discount to a 3rd party all or part of any of the financing arrangements.
Training and Assistance: The franchisor will provide training for the franchisee and Permitted Representatives to educate about the system. The total training consists of 10.5-16.5 hours of classroom training, and optional on-the-job training. In addition, the franchisor will provide a copy of the proprietary software, and help install it on the order entry computer.
Territory: The franchisee will not receive an exclusive territory. He or she may face competition from other franchisees, from outlets that the franchisor owns, from affiliates, or from other channels of distribution or competitive brands that the franchisor controls.
Term of Agreement and Renewal: The length of the franchise term is 5 years, with the option to renew for an additional 5 year period.
Obligations and Restrictions: The franchisee must personally operate or supervise the franchised business. If the franchisee is a legal entity, they must designate an operating principal to personally operate or supervise the franchised business. The franchisee or any operating principal must attend and successfully complete the New Franchise Training Program. The franchisee may not be involved in any business that is in competition with Winzer while operating the franchised business. The franchisee may sell approved Winzer Products that are manufactured or distributed by Winzer. If the franchisee wishes to sell any product that is not on the approved Winzer products list, they must follow the procedures, obtain proof of product liability insurance for the product with coverage types and limits reasonably satisfactory and naming the franchisee as an additional insured, and pay a service fee to the franchisor on the sales of franchisee products.
