Description: The franchisee will operate a Hungry Howie's restaurant, offering pizza, submarine sandwiches and other designated menu items for sale.
Franchise Offer: The franchisor grants the right to sell pizza, submarine sandwiches, salads, desserts and beverages under the names "Hungry Howie's Pizza" or "Hungry Howie's". The franchisor offers carry-out and delivery restaurants. Restaurants generally occupy their own premises and provide specified food items and beverages for carry-out, delivery and, in a limited number of instances, for consumption on the premises.
Financial Assistance: Neither the franchisor nor any affiliate offers direct or indirect financing. Neither the franchisor nor any affiliate will guaranty the note, lease or obligations.
Training and Assistance: The Hungry Howie's training program is mandatory. The Franchisee or the individual who will be involved in the conduct and operation of the restaurant must successfully complete the training program to the satisfaction of Hungry Howie's. The four week training program is conducted approximately eight times a year. Franchisee is responsible for personal expenses in connection with the training program including costs and expenses of transportation, lodging, meals, wages and employee benefits. There is no cost for the training program.
Territory: The general area in which the restaurant will be located will be a city or an area bounded by streets or roads. The franchisor will not operate restaurants or grant franchises using the trademarks for a similar or competitive business within a one mile radius of the Restaurant, called the exclusive territory. Other Hungry Howie's franchisees may make deliveries into the exclusive territory. The franchisee is not prohibited from delivering into the Exclusive Territory of any other Hungry Howie's franchisee. There is nothing that prohibits other franchisees from soliciting business in the exclusive territory and there is nothing that prohibits the franchisee from soliciting business in the exclusive territory of any other franchisee.
Term of Agreement and Renewal: The length of the Franchise Agreement is 20 years. Renewal or extension of the term is one option of 20 years.
Obligations and Restrictions: The franchisee must personally be involved in the conduct and operation of Restaurant. If the franchisee is not on the premises, a trained manager under the supervision must be at the Restaurant while it is open for business.
