Description: Ruby Tuesday restaurants is a full-service restaurant featuring a specialized menu of soups, burgers, chicken, health and fitness-oriented items and full-service bar under the service mark Ruby Tuesday, which is in the bar and grill segment of casual dining.
Franchise Offer: The franchisor is offering three distinct franchising programs:
(i) Franchise partnership program - these exist in domestic markets and are located in certain parts of the Midwest, Northeast, and Western United States. Lines of credit and other forms of financing are available to partnership franchisees.
(ii) Traditional domestic franchise program - Traditional franchisees must obtain support services from the franchisor including technology-related services. Lines of credit and other forms of financing are not available to traditional franchisees.
(iii) Development agreement - to develop multiple restaurants within a specifically described geographic territory.
Financial Assistance: The franchisor does not offer or arrange direct or indirect financing for traditional franchisees. For franchisees in the franchise partnership program, there are twelve lenders who offer financing to licensees, referred to as the "Secured Lender Group". The franchisee must pay a 0.25% fee of the loan amount of each loan receive from the Secured Lender Group, to the franchisor.
Training and Assistance: The operating principal (or their designee), general manager and secondary managers must satisfactorily complete the initial training program before the opening of the restaurant. The initial training will be conducted in a Ruby Tuesday restaurant approved as a qualified training restaurant, and will require 15 weeks to 25 weeks to complete.
Territory: The franchisee will be granted the right to operate their franchise restaurant within a protected territory. The franchisor retains the right to advertise, provide catering and delivery services, and offer and sell Ruby Tuesday memorabilia, in the area.
Term of Agreement and Renewal: The length of the franchise term is 15 years, with an option for renew for two additional consecutive 5 year terms.
Obligations and Restrictions: The franchisee and the operating principal must devote substantial full time and best efforts to supervising and conducting the franchise business. The operating principal must serve as the general manager, or designate another individual to serve as the general manager of the restaurant.
