Description: The franchise is a frozen yogurt shop featuring delicious soft serve frozen yogurts, manufactured on premise with approved soft serve machines and approved flavorings, a variety of fresh fruit toppings and dry toppings including but not limited to nuts, granolas, cereals, and candied toppings, as well as sundae toppings including chocolate, caramel, marshmallow, peanut butter, and fudge.
Franchise Offer:
- The ZIIING Yogurt Shop will feature ZIIING based beverages, including smoothies, shakes and coffee beverages made with soft serve and hand scooped yogurts, sorbets, sherbets, IQF (individually quick frozen fruits) and juice blends. The ZIIING Yogurt Shop may also offer a variety of ZIIING cakes and/or pies, ZIIING sundaes, splits and parfaits.
- Shop-in-shop locations will offer a limited menu, subject to change over time as they may specify in the ZIIING operations manual for "Juice It Up" stores, presently contemplated to focus on the healthier product offerings to fit within the "healthier for you" products offered in a "Juice It Up" shop. These include the tart based soft serve frozen yogurts, fresh fruits and healthy dry toppings, and not the more indulgent toppings and yogurts offered in the stand-alone ZIIING Yogurt Shops.
Financing: Ziing does not offer direct or indirect financing. Ziiing does not guarantee notes or obligations.
Territory:If a franchisee signs a deposit agreement, they have 6 months (unless agreed in writing to a longer period) to locate a site within a non-exclusive general territory. The franchisor may conduct whatever franchise sales activities they deem appropriate within that target area. After the franchisee has found an acceptable site he must sign a franchise agreement for the accepted location.
Training and Assistance: Classroom training will be administered at Ziiing's corporate headquarters in Irvine, California. Hands-on training will take place in one or more shops in Orange County, California, or at the corporate training center. Ziiing will send a representative to the new Ziiing Yogurt Shop for up to 50 hours (4 hours in the case of a shop-in-shop location within a "Juice It Up" store) to assist the franchisee with opening, and conducting "on-the-job" training for the staff. The on-the-job training will cover certain aspects of store operations, including "early morning" store opening procedures and "end-of-the day" store closing and clean up procedures.
The franchisee and the designated manager must attend the orientation program. The Ziiiing Yogurt Shop can not be opened to the public until the franchisee, the designated manager, and not more than 2 additional individuals who will work at the new ZIIING Yogurt Shop must attend, participate in, and successfully complete the initial training program and the "Hands-On" training program to Ziiing's reasonable satisfaction.
Obligations and Restrictions: The franchisee or the person who has been employed as the designated manager must devote all his or her productive time and effort to the management and operation of the Ziiing Yogurt Shop, in the minimum amount of 40 hours per week. Upon the termination of employment of a designated manager, the franchise owner must appoint a successor within 30 days. Any successor to the designated manager must successfully complete the training program conducted by Ziiing's, at the franchisee’s expense, before starting work in the Ziiing Yogurt Shop.
Term of the Franchise Agreement and renewal: The term of the franchise agreement is 10 years and if certain conditions are meet; the agreement can be renewed for two additional 5-year terms.
