Business Description: The Glass Guru Franchise Systems, Inc. is the franchisor. Franchisees operate a business offering glass, window and door restoration and replacement services for residential and commercial customers.
Franchise Offer: The franchisor grants franchises to qualified persons or business entities in connection with the service mark “The Glass Guru” and other related trademarks and logos.
Financial Assistance: If franchisees meet the franchisor’s credit standards, it may finance a portion of the initial franchise fee. The portion financed must not exceed 30% of the total initial franchise fee. The availability of this installment payment option will be subject to the sole discretion of the franchisor. The financing provided by the franchisor includes only the Initial Franchise Fee as described. The franchisor does not provide financing or guarantee the franchisee’s lease or any other obligations.
Training and Assistance: The franchisor will conduct an initial training program that the Designated Manager (which is the franchisee, if the franchisee is not a corporation or other business entity) must attend and complete to our satisfaction. Although initial training is mandatory for the Designated Manager, it is also available for one office assistant and up to two additional field or office assistants with prior approval from the franchisor. Training will take place at the franchisor’s headquarters or at another location it designates on an as needed basis as it may determine. Periodically, the franchisor may require that previously trained and experienced franchisees, managers or employees attend refresher-training programs to be conducted at the franchisor’s headquarters or another location. The franchisor may hold an Annual Convention of franchisees, and if it does, franchisees or their Designated Manager must attend the Annual Convention.
Territory: The franchisor will grant franchisees a minimum Area of Primary Responsibility that consists of a geographic area surrounding the Franchised Business. The Area of Primary Responsibility may be either a metropolitan”+” market containing a population of 1,000,001 or more; a metropolitan market containing a population of between 750,001 to 1,000,000 persons, a major market containing a population of between 500,001 to 750,000 persons, a minor market containing a population of between 250,001 to 500,000 persons, or a micro market containing a population from 10,000 to 250,000. Franchisees will not receive an exclusive service territory. Franchisees may face competition from other franchisees, from outlets that the franchisor may own in the future, or from other channels of distribution or competitive brands that the franchisor controls.
Term of Agreement and Renewal: The initial franchise term is 5 years. Franchisees may renew for 3 additional terms of 5 years each, if conditions are met.
Obligations and Restrictions: The Franchised Business must always be under the direct full-time supervision of a Designated Manager, which is the franchisee if you are an individual, or is an individual selected if the franchisee is a business entity. The Designated Manager must attend and satisfactorily complete the initial training program before opening the Franchised Business. Franchisees must operate the Franchised Business in strict conformity with the methods, standards and specifications in the Manual and as the franchisor may require otherwise in writing. Franchisees may not deviate from these standards, specifications and procedures without our written consent. Franchisees must offer the services and products the franchisor specifies in strict accordance with its standards and specifications.
