Training Overview: No later than 125 days prior to opening the studio, (i) the franchisee or the operating principal must have attended and satisfactorily completed the business owner training, which consists of (a) online learning modules, and (b) classroom training, typically taking 2-3 business days. Business owner training takes place at the franchisor’s corporate headquarters in Fort Worth, Texas, or online/remote. Additionally, the franchisee and/or the studio manager must attend and satisfactorily complete the studio manager training no later than 60 days prior to the opening of the studio. Studio manager training takes place at the franchisor’s corporate headquarters in Fort Worth, Texas, or online/remote. The fitness manager must also attend and satisfactorily complete the fitness manager training no later than 60 days prior to the opening of the studio. Fitness manager training takes place at the franchisor’s corporate headquarters in Fort Worth, Texas, or online/remote. Prior to opening the BODYBAR Studio, all instructors must satisfactorily complete Module 1 of the BODYBAR Pilates Founding Instructor Training Program. The franchisor also may require the operating principal, developer, or a designated representative from the franchisee’s organization to attend additional and refresher training programs and seminars each year as the franchisor may require in its sole discretion.

Territory Granted: The franchisor will grant franchisees a protected area within which it will not open another studio under the marks and system. The protected area’s boundary around the location will depend on the market area, including population density, drive times, and similar factors. There is no set minimum or maximum radius. If franchisees are in compliance with the Franchise Agreement and any other agreement they have with the franchisor or its affiliates, the franchisor and its affiliates will not establish or authorize anyone except the franchisee to establish a BODYBAR studio, with the exception of any “reserved venue,” in the protected area during the term of the Franchise Agreement. If franchisees do not meet the specified minimum gross sales requirements, the franchisor has the right to terminate the protected area or otherwise terminate the Franchise Agreement.

Obligations and Restrictions: When franchisees sign the Franchise Agreement(s), they must designate an individual to serve as the “operating principal.” The same person must act as the operating principal under any and all Franchise Agreements with the franchisor and, if applicable, the Development Agreement. Franchisees may, at their option and subject to the franchisor’s written consent, designate a studio manager and/or fitness manager to supervise their operations under each Franchise Agreement. All service franchisees provide and all products they use or sell at the franchise must conform to system standards. Franchisees must offer and sell all services, items, and products the franchisor requires.

Term of Agreement and Renewal: The length of the initial franchise term is 10 years. If franchisees are in good standing, upon expiration of their original Franchise Agreement, they will have the right to renew their franchise for two additional five-year terms.

Financial Assistance: The franchisor does not offer direct or indirect financing. The franchisor does not guarantee a franchisee’s notes, leases, or obligations. The franchisor has relationships with 3rd party financial institutions who may be able to help a qualified franchisee with financing options. The franchisor offers franchisees that are actively serving in the military and/or military veterans that have been honorably discharged from duty a reduced initial franchise fee of $55,000.
