Training Overview: The franchisor will provide a training program that consists of a self-paced online learning course and assessment tool which must be completed in a manner satisfactory to the franchisor, then 3 to 5 days of classroom training conducted at its corporate offices in Minnesota, at its discretion, followed by a one to three day in-person job shadowing training experience held at a location that the franchisor designates. The principal operator of the business must attend and complete training to the franchisor’s satisfaction before the franchisee opens the Anytime Fitness center. In addition, if the principal operator is not also a principal owner, then a principal owner of the business must also attend and complete the training to the franchisor’s satisfaction before the Anytime Fitness center is opened. After the first year of operation, during the time franchisees operate their business, they must attend additional training, which may be offered in person, by webinar, online, or in another virtual format, in order to earn continuing engagement credits and stay current on the policies, procedures, and techniques of operating an Anytime Fitness center.

Territory Granted: Once the location for the Anytime Fitness center has been approved, the franchisor will grant franchisees a protected territory. To identify the protected territory, the franchisor will use mapping and demographic software to draw a circle around the location. The determination of the protected territory is within the franchisor’s sole discretion. The radius of the circle identifying the protected territory may vary, but it will be no larger than three miles and the protected territory will include a population of no more than 30,000 people. Protected territories may overlap, but the franchisor will not approve anyone opening an Anytime Fitness center, or relocating an Anytime Fitness center, into a protected territory given to another Anytime Fitness center.

Obligations and Restrictions: While it is not required that franchisees personally supervise their Anytime Fitness center, the franchisor recommends that they do so. If the franchisee is not the “on premise” supervisor of the business, a principal operator must be designated to serve as the on premises supervisor. The principal operator of the business must complete initial training requirements and all other training reasonably designated and, at the franchisor’s discretion, that person must sign a confidentiality agreement with the franchisee that meets the franchisor’s requirements and that the franchisee provides to Anytime Fitness before they attend training. Franchisees may offer only those products and services that are approved and only from the location that is approved. Franchisees must offer all products and services that are designated as required for all franchisees.

Term of Agreement and Renewal: The initial term is six years. If franchisees are in good standing, they can renew the Franchise Agreement for an additional five-year period.

Financial Assistance: The franchisor does not generally offer, directly or indirectly, any other financing to help franchisees establish their business. However, the franchisor does have arrangements with a number of third-party equipment lenders who provide financing to its franchisees. The franchisor does not guarantee any note, lease or other obligation franchisees incur.
