Territory Granted: Franchisees are granted the right to operate the office at a specific address-only location that first must be approved. Franchisees will not receive an exclusive territory. Franchisees may face competition from other franchisees, from outlets that the franchisor owns, or from other channels of distribution or competitive brands that the franchisor controls.
Obligations and Restrictions: Franchisees will be required to operate the office in accordance with the provisions of the Franchise Agreement, to perform all obligations contained in the Franchise Agreement and to continuously exert their best efforts to promote and enhance the business of the office for the term of the Franchise Agreement. Franchisees will not be permitted to engage in any other real estate business or other business or enterprise that may be in competition with RE/MAX. Neither franchisees nor their owners, if they are a business entity, will be required to participate personally in the direct operation of the office, although the franchisor recommends that the franchisee or a principal owner do so, in which event the franchisee or the principal owner will be required to at all times hold a valid state real estate broker license or such other state license as may be required to act as the managing or designated broker of record. Franchisees will be expected to meet high standards of real estate service and professionalism reflective of the goodwill and respect enjoyed by the RE/MAX name and organization. The Franchise Agreement will establish a sales associate minimum agent count for the office. The minimum agent count is based upon a number of criteria.
Term of Agreement and Renewal: The length of the initial franchise term is five years. If franchisees meet the requirements for renewal, they may renew by executing the form of Franchise Agreement used at the time of renewal, which may have materially different terms and conditions than the original Franchise Agreement. The current renewal term is five years although franchisees may be granted a longer term depending upon the renewal provisions in their expiring Franchise Agreement.
Financial Assistance: RE/MAX Regional offers financing to prospective franchisees for the initial franchise fee and, for renewing franchisees in good standing, the renewal franchise fee. In the franchisor’s discretion, it may also provide franchisees with financing to assist them with acquisition or other growth-related expenses.
