Franchisees will not receive an exclusive territory, however, their territory will be protected from other Send Me a Pro Area Representative business franchise owners, from outlets that the franchisor owns. Franchisees may operate their business only within the approved franchised territory. There is no specific minimum or maximum area the franchisor must include in the franchised territory, but it estimates that the area will contain a minimum of 500,000 people according to either relevant United States Census figures or its source tools used for territory mapping as of the effective date of the agreement.
Obligations and Restrictions: If franchisees are an individual, they must personally operate the franchised business at all times. Franchisees and any other manager, if any, must attend and successfully complete initial training. If franchisees are a legal entity, they must designate a managing shareholder, partner, or member, who must own at least 10% of the entity (the “operating principal”). Franchisees must offer for sale and sell only services and products that the franchisor has approved or authorized. Franchisees may not offer for sale or sell services or products that would detract from or be inconsistent with the system.
Term of Agreement and Renewal: The length of the initial franchise term is 10 years. If franchisees are in good standing and they meet other requirements, they have the right to renew the Area Representative Agreement for successive 10-year terms.
Financial Assistance: The franchisor does not offer direct or indirect financing. The franchisor does not guarantee an area representative franchisee’s note, lease, or any of the financial obligations.
