Territory Granted: The territory will be for a specific geographic region defined by zip codes, natural, or political boundaries. A territory will normally include a population of approximately 125,000 residents, as determined by the U.S. Census Bureau or mapping software that the franchisor feels is reliable. Franchisees will receive an exclusive territory, meaning a geographic area within which the franchisor promises not to establish either company-owned or franchised outlets selling the same or similar goods or services under the same or similar trademarks or service marks. Franchisees may only operate their outlet (the vehicle) within this territory.
Obligations and Restrictions: Franchisees or a fully trained and qualified manager must personally supervise and participate in the day-to-day operation of the franchised business unless the franchisor permits otherwise in writing. Franchisees must devote their time, attention and best efforts to performing the obligations under the Franchise Agreement. While franchisees may designate a business manager to fulfill their obligations of day-to-day management, they are still responsible. Franchisees must offer and sell only the goods and services that the franchisor approves, and they must sell all the goods and services that the franchisor authorizes.
Term of Agreement and Renewal: The length of the initial franchise term is 10 years. The term can be renewed for successive terms if franchisees are in compliance with their Franchise Agreement.
Financial Assistance: The franchisor does not offer, either directly or indirectly, any financing arrangements to franchisees. The franchisor does not guarantee a franchisee’s notes, leases or other obligations. The franchisor offers a 10% discount to all qualified veterans and first responders who purchase a territory. The franchisor may also offer limited incentive programs as part of its franchise development efforts. The franchisor reserves the right to offer, modify, or withdraw any such incentive program without notice.
