Territory Granted: Franchisees must operate their restaurant from one specific location that the franchisor has approved. Once the location is approved, franchisees are granted a protected area that will be described in the Franchise Agreement. For non-urban locations, the protected area will be the geographical area within four miles of the front door, by road, of the restaurant location using the roads in existence at the time of the date of the Franchise Agreement. If the franchise location is in an urban area, the protected area will be the geographic area within up to two miles of the front door, by road, of the restaurant location using the roads in existence at the time of the date of the Franchise Agreement. The size of the protected area will be determined by the franchisor and based on population density, traffic flow, geographical barriers and other considerations. The continued right of territory protection does depend on the maintaining of a specified gross sales volume.
Obligations and Restrictions: The franchised business must always be under the direct supervision of the named manager who must speak, read and write in English, which may be the franchisee. The named manager must devote full-time, personal attention to the franchised business. Unless the franchisor otherwise agrees in writing, the franchisee must be one of the trainees. Franchisees must offer the services, and products specified periodically in strict accordance with the franchisor’s standards and specifications. Franchisees may not sell any services or products that the franchisor has not authorized in writing and must discontinue offering any services or products that the franchisor may disapprove of within 30 days’ written notice.
Term of Agreement and Renewal: The length of the initial franchise term is 20 years. If conditions are met, franchisees may renew for an additional 10-year term.
Financial Assistance: At the franchisor’s choice, based upon its sole discretion, it has decided at this time to not offer any in-house financing options. However, the franchisor may assist franchisees in obtaining outside financing for their franchise. The franchisor offers a veteran discount when of 25% off the initial fees, if qualified, for U.S. military who are also eligible for VetFran membership.
