If you’re looking for an exciting new business opportunity, then look no further than “The Bay State.” With 6.4 million residents and many franchised businesses already in place, Massachusetts could be the perfect home for your new venture. Massachusetts has set the precedent for many issues, including massive health-care reform in 2006.



 

The law requires residents to have health care coverage and places requirements on employers; an employer with 11 or more full-time equivalent employees must contribute 33% or more toward an employee’s heath insurance premium and have more than 25% of their employees enrolled in the employer sponsored health plan. If not, they must pay a $295 fine per FTE employee.



 

Other states are trying to copy this health care model. Franchise relationship legislation was reintroduced in 2007; this legislation would put new state guidelines and mandates on the franchise agreement, especially the termination process. No action was taken, although the bill may come up again in 2008. Restaurant mandates, including mandatory menu labeling and bans on trans fatty acids in cooking oil, are still issues in Massachusetts; since these bills place mandates on “chain” or franchised restaurants, franchise owners must be vigilant.
