Franchise Offer: Ameci grants the right to operate a fast service, limited menu Italian restaurant. The franchisee must sell only pizza, pasta, Italian-style sandwiches, soft drinks, and other items that are part of the Ameci standard menu. The franchisee must provide fast, take-out service and may be required to offer some limited on-premises eating facilities and/or delivery service.
Financial Assistance: Ameci does not offer direct or indirect financing.
Training and Assistance: Ameci conducts a training program in the management and operation of the franchised business. The initial training is held for the franchisee or up to 2 equity owners of the corporation or partnership and one manager and consists of 18 days classroom and field training. The training course is followed by additional training, preparation, and assistance at the franchise location for at least 7 days after opening, during which the franchisee operates the business under the supervision of an Ameci representative. Amecimust provide the franchiseewith a one-day refresher training course every year. mecimaintains and administers a fund for national and regional or local promotion, marketing and advertising.
Territory: Under the franchise agreement, the franchisee receives an exclusive right to use the Ameci trade name and marks in connection with the franchised business only from the Ameci approved location. Ameci cannot operate or sell a franchise of another Italian-style restaurant within a certain radius (protected area) from the location. The protected area is determined by Ameci based upon the franchise location. Ameci may establish any other licensed, franchised, or company-owned business within the protected area of a particular franchise location, so long as that business uses a trade name, trademarks, and service marks other than the ones licensed to the franchisee and is not an Italian-style restaurant. The franchiseedoes not receive the right to acquire additional franchises within their protected area.
Term of Agreement and Renewal: The term of the franchise agreement is 10 years. If the franchisee is in good standing they can add one additional term of equal to the number of years remaining on the lease of the franchise location but no more than 10 years.
Obligations and Restrictions: The franchisee, or a managing equity owner or a qualified manager, must devote full time and best efforts to the day to day operations of the franchised business with no operational or management commitments in other businesses except other Ameci franchises. The franchisee must offer only those menu items and services approved by Ameci as comprising the Ameci system and operate strictly in accordance with the Ameci system and menu.
